Short terms,
plainly written.
These govern orders placed with us. They are deliberately brief, because a set of terms nobody reads protects nobody.

The short answer
Quotes are firm for seven days on the stock described. Grades follow our published definitions. Inspect on delivery and raise problems within 48 hours with photographs. Container suitability for your specific product is your determination, not ours. Payment is prepaid on first orders, net-30 on approved accounts.

1. Who these terms are with
IBC Tote Texas LLC, 3505 Montopolis Dr, Austin, TX 78744 (“we”). They apply to all sales, services and purchases unless we have signed a separate written agreement with you that says otherwise.
2. Quotes
Quotes are firm for seven days from issue, for the stock, quantity and specification described. Used inventory moves, so an expired quote may reference units that have gone. A quote is not a reservation of stock unless we have said so explicitly in writing.
All quotes are issued in writing. We do not operate a telephone line and we do not make verbal commitments.
3. Grades and descriptions
Grades follow the definitions published at /resources/grades-explained as of the date of the quote. Wash standards follow the definitions at /services/washing-and-reconditioning/wash-standards.
Used containers vary. Cosmetic variation within a grade is expected and is not a defect. Structural variation is not, and is covered under section 6.
4. Payment
- First orders: prepayment by card or ACH before dispatch or collection.
- Approved commercial, municipal and school-district accounts: net-30 from invoice date after an initial prepaid order.
- Title passes on payment in full. Risk passes on delivery or collection.
- Overdue accounts may be suspended and are subject to reasonable collection costs.
5. Delivery and collection
Delivery dates are given in good faith based on scheduled routes and are not guaranteed against weather, road closures, mechanical failure or your site being inaccessible.
You are responsible for providing safe, level access suitable for the agreed equipment, and for having someone present to receive the delivery. Where a site cannot accept the equipment specified, a re-delivery charge may apply.
For collection at our yard, you are responsible for load securement. We will load with a forklift at no charge; we do not strap loads.
6. Inspection and claims
Inspect on delivery or collection. Raise any shortage, damage or grade discrepancy within 48 hours of receipt, in writing, with photographs. We will resolve confirmed problems by replacement, credit or collection at our option.
Claims raised after 48 hours, or after a container has been filled, modified or cut, can only be considered where the defect could not reasonably have been found on inspection.
7. Container suitability
This is the important one. We supply containers, specifications and every material fact we hold. The determination that a specific container is suitable for a specific product, application or regulated material is yours.
Where a shipment involves regulated materials, you are the offeror and carry the legal responsibility for compliance under 49 CFR, including verification of marking validity and retest currency. See /resources/dot-un-compliance.
We do not certify containers to manufacturer-level programmes such as NSF/ANSI 61, and we do not provide allergen-free guarantees on reused bottles.
8. Containers we buy from you
- You warrant that you own the containers and that they are free of encumbrance.
- You warrant that prior contents have been declared accurately and that containers have been rinsed and drained.
- We cannot accept containers holding residual regulated waste, and units found to contain it may be returned at your cost.
- Prices quoted from photographs are subject to confirmation on physical inspection at intake.
9. Services
For washing, rebottling, fabrication and fleet management performed on containers you own: we execute the specified work and document it. We do not validate cleaning protocols you supply, and we do not accept liability for the suitability of a protocol you specified.
Containers we assess as beyond economic repair will be reported to you before any irreversible action is taken.
10. Liability
Our liability for any order is limited to the value of that order. We are not liable for indirect or consequential loss, including lost product, lost production, downtime or third-party claims arising from your use of a container.
Nothing here limits liability that cannot lawfully be limited.
11. Governing law
These terms are governed by the laws of the State of Texas, and the courts of Travis County, Texas have exclusive jurisdiction.
12. Changes
We may update these terms. The version in force is the one published on the date of your quote.
